Bicycle Rental Agreement

Bicycle Rental - PLEASE READ AND SIGN THE AGREEMENT BY CHECKING THE BOX BELOW *

Mad Beach Rentals, LLC, DBA Mad Beach Paddle Sports And Affiliated Sponsors Contracted To Offer Services Bicycle Assumption of Risk, Waiver & Release Agreement Assumption of Risk: I understand and accept that renting this bicycle exposes me to many hazards and entails the risk of death, personal injury (including but not limited to severe spinal or head injury) and loss of or damage to property. I also understand I should be in good physical health to participate in biking. I choose to participate in biking in spite of these risks and hereby assume all risk of injury or loss of life to myself and others and loss of or damage to property arising out of renting this bicycle and participating in biking. I understand the inherent risk involved in using this equipment, accept full responsibility for any and all such damage or injury which may result. Waiver and release:In consideration of Mad Beach Rentals, LLC, its officers, owners, employees, agents and assigns and any SPONSOR or REPRESENTATIVE contracted to offer Mad Beach Rentals, LLC services, henceforth referred to as SPONSOR PARTNERS, renting this bicycle to me, I specifically release and forever discharge, and hold harmless Mad Beach Rentals, LLC, its officers, owners, employees, agents and assigns and any SPONSOR PARTNERS from any and all liability or claims for personal injury, illness, loss of life or damage to property which I may suffer while renting this bicycle and participating in biking, whether caused by negligence, breach of contract, breach of warranty or any other legal theory, by Mad Beach Rentals, LLC, its officers, owners, employees, agents and assigns and any SPONSOR PARTNERS. Mad Beach Rentals, LLC and their SPONSOR PARTNERS and/or their staff have answered any questions that I have. I have been advised to wear protective headgear while participating in biking. As a legal adult if I voluntarily choose to forgo wearing protective headgear, I do so at my own risk and accept responsibility for any and all risks this voluntary decision entails. In addition, if I am the parent or legal guardian of a minor child under the age of 16 (sixteen), I understand that he/she is required by law to wear protective headgear at all times while participating in biking and have been supplied appropriate headgear by Mad Beach Rentals, LLC and/or their SPONSOR PARTNERS at the time of service. I also understand and agree to accompany my minor child at all times while utilizing the equipment acquired by Mad Beach Rentals, LLC and/or their SPONSOR PARTNERS. I further understand and agree that I will be charged the full value of the equipment, at the sole discretion of Mad Beach Rentals, LLC, should it not be returned in the condition it was rented in, minus normal wear and tear. Furthermore, I have reviewed the policy on the timely return of equipment located on the website at www.madbeachpaddlesports.com and understand that should the equipment not be returned in a timely manner, I could be responsible for additional charges at the sole discretion of Mad Beach Rentals, LLC. I HAVE CAREFULLY READ THIS AGREEMENT AND UNDERSTAND ITS CONTENT. I AM AWARE THIS IS AN ASSUMPTION OF RISK, WAIVER AND RELEASE OF LIABILITY AND I SIGN IT VOLUNTARILY. I ALSO UNDERSTAND AND AGREE TO FOLLOW ALL LAWS OF THE STATE OF FLORIDA. I UNDERSTAND THAT IT IS ILLEGAL TO OPERATE A BICYCLE WHILE UNDER THE INFLUENCE OF ALCOHOL AND/OR DRUGS AND AGREE THAT I WILL NOT AND MAY NOT PARTICIPATE IN THIS ACTIVITY IF I AM UNDER THE INFLUENCE OF ALCOHOL OR DRUGS.
